Welcome to Vcard.tel (referred to below as the "Platform," "we," or "Vcard.tel"). These Terms & Conditions (the "Agreement") form a fully binding legal contract between you and Vcard.tel, whether you act as an individual visitor, a registered subscriber, or an authorized representative of a business entity, governing your access to this website and your use of the global digital business card builder and related SaaS services.

By visiting the platform website, registering an account, clicking an "Agree" or "Accept" button, or starting to use any material feature of the platform, you confirm that you have fully read, understood, and accepted all terms of this Agreement, including its separate sections, disclaimers, and privacy policy. If you do not agree with any part of this Agreement, please stop the registration process immediately and discontinue all use of the platform's services.

1. Limitation of liability and disclaimer

Given the nature of internet services and the complexity of cross-border business, you expressly understand and agree that, to the maximum extent permitted by applicable law, the platform is not liable for compensation or joint liability in the following circumstances while you use the global digital business card and aggregated profile services provided by vCard.tel (the "Platform"):

  • 1.1 Disclaimer for service interruptions and technical failures
    As an independent technical service provider, the platform will use commercially reasonable efforts to maintain continuous and stable system operation. However, vCard.tel is not liable for breach or damages caused by service delay, interruption, or temporary inaccessibility of your digital business card in certain global regions due to routine maintenance, server upgrades, transnational network congestion, CDN node failure, or other technical causes beyond the platform's direct control.
  • 1.2 Disclaimer for third-party platform restrictions and API changes
    Features such as aggregated links and one-click communication provided by vCard.tel rely heavily on the APIs and operating policies of third-party platforms, such as WhatsApp, LinkedIn, Facebook, and overseas email systems. If those third-party platforms change their rules, restrict access, block your card link, or interrupt interface services so that related redirects or communication features stop working, the platform bears no responsibility and this will not be considered a breach.
  • 1.3 Disclaimer for commercial outcomes and direct or indirect loss
    The platform provides tools only for generating, displaying, and hosting your business card pages. We make no express or implied guarantee regarding conversion rates, lead generation effectiveness, transaction success, or cross-border business expansion results arising from your use of the service. We are not liable for any direct, indirect, incidental, special, or punitive damages caused by the use of or inability to use the service, including but not limited to lost profits, harm to goodwill, data loss, or business interruption, whether or not the platform was advised of the possibility of such damages.
  • 1.4 Disclaimer for data security and backups
    Although the platform adopts industry-standard encryption and security measures, no internet environment can guarantee absolute security. vCard.tel is not liable for direct compensation if malicious events such as hacking, computer viruses, or unauthorized third-party access result in your card data being altered, disclosed, or lost. You are responsible for maintaining local backups of important customer information and business data.
  • 1.5 User content and compliance indemnity
    You bear full and independent legal responsibility for all content uploaded, published, and displayed on vCard.tel, including trademarks, product images and copy, external links, and similar material. If your digital business card is used for spam, fraud, infringement of third-party intellectual property rights, or any violation of applicable laws and regulations in China or your target overseas markets, all resulting claims, lawsuits, administrative penalties, and direct losses are your sole responsibility. You agree to fully indemnify and hold vCard.tel harmless in such cases.
  • 1.6 Force majeure
    vCard.tel is fully exempt from liability under applicable law if natural disasters, epidemics, war, strikes, riots, government actions, international trade sanctions, court orders, or major telecommunications infrastructure damage prevent the platform from performing this agreement or impair the service.
  • 1.7 Maximum financial liability
    In all cases, regardless of the nature of the claim, the legal basis, or the form of action, whether for breach, tort, negligence, or otherwise, the total cumulative liability of vCard.tel and its affiliates to you will not exceed the total subscription fees actually paid by you for the specific service during the [6 months] before the event giving rise to the claim. If you use a free trial or free plan, the platform bears no financial compensation liability to you.

2. License

Subject to your compliance with this Agreement and timely payment of applicable subscription fees, vCard.tel grants you a limited, non-exclusive, non-transferable, and revocable license to access the platform through supported web browsers and create, edit, and present global digital business cards and aggregated profile pages to your customers.

This license is limited to lawful business use by you or the business you represent. You may not reverse engineer, decompile, disassemble, or attempt to extract the source code of the platform system, underlying architecture, or related code, nor may you resell, rent, or distribute the service to any third party.

3. Ownership and responsibility

Platform ownership: Ownership of the vCard.tel platform and all intellectual property rights in it, including but not limited to software code, page design, card templates, UI interfaces, and brand trademarks, belongs to us or our licensors.

User content and responsibility: All content you upload, publish, and display on vCard.tel, including but not limited to company logos, product images, text descriptions, third-party links, and contact details, remains your property and intellectual property. You must ensure that the content is lawful and compliant and does not infringe any third party's intellectual property rights or privacy rights.

Cross-border compliance: Because your card may be displayed globally, you are solely responsible for ensuring that your content complies with the laws and regulations of the countries or regions you target. vCard.tel is not responsible for the legality of your business content, products, or commercial commitments.

4. Refund policy

vCard.tel provides digital business card SaaS services on a subscription basis. Unless mandatory law requires otherwise, the platform's refund policy is as follows:

First-purchase refund guarantee: We provide first-time paid subscribers with a 7-day no-questions-asked refund window. If you are dissatisfied during that period, you may request a full refund.

Renewals and mid-cycle cancellation: After the refund guarantee window has passed, all paid subscription fees, including monthly and annual plans, are non-refundable. You may cancel your subscription at any time before the end of the current billing cycle. After cancellation, premium features on your digital business card will stop at the end of that cycle, and no prorated refund will be issued.

5. Warranty disclaimer

The platform and all related services are provided on an "as is" and "as available" basis. vCard.tel expressly disclaims all express and implied warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the system will operate without interruption or error at all times, nor that every defect will be corrected immediately. We also do not guarantee that using vCard.tel digital business cards will necessarily bring you any particular traffic, leads, or sales conversions.

6. Account termination and suspension

If you violate any term of this Agreement, vCard.tel reserves the right to suspend or permanently terminate your account and access at any time without prior notice. Violations that may lead to account termination include but are not limited to:

  • Failure to pay subscription fees on time;
  • Using digital business cards for fraud, spam, phishing links, or any unlawful cross-border transaction;
  • Uploading content involving violence, pornography, hate speech, or serious infringement;
  • Launching malicious attacks against platform servers or abusing system resources.

After account termination, we have the right but not the obligation to delete all data and files associated with your card immediately, and you are responsible for keeping your own backups.

7. Privacy policy

We highly value your privacy and the security of your customers' data. Our collection, use, and storage of your personal information and address book data while you use the vCard.tel platform are governed by the vCard.tel Privacy Policy.

As a service provider for international markets, we are committed to mainstream global data protection standards, including the core principles of GDPR. We collect only the data necessary to operate the platform, process payments, and improve user experience, and we never sell your registration information or visitor data from your digital business card to unauthorized third parties.
